PRIVACY POLICY & END USER LICENSE AGREEMENT (EULA)

1. THE ZERO-FOOTPRINT GUARANTEE

Fyx is engineered on a strict, uncompromising principle of data sovereignty. This application is entirely stateless regarding external servers.

Fyx does not possess cloud connectivity, analytics trackers, telemetry reporters, or third-party advertising modules. Fyx does not collect, harvest, transmit, sell, or distribute your personal data. Your data belongs exclusively to you and remains entirely encrypted on your physical device.

2. HARDWARE PERMISSIONS & JUSTIFICATION

To function as a Ring-0 cognitive intervention engine, Fyx requires specific hardware permissions. Below is the exhaustive list of what is accessed, why it is necessary, and how it is protected:

• Microphone (RECORD_AUDIO): Utilized exclusively for the “Ephemeral Purge / Dead Man’s Switch” module. Audio data is streamed directly into a temporary RAM buffer to force verbal articulation of intrusive thoughts. At no point is audio written to the device’s hard disk, saved, or transmitted. The RAM buffer is cryptographically zero-filled (wiped) immediately upon release of the switch.
• Bluetooth & Location (BLUETOOTH_SCAN, BLUETOOTH_CONNECT, ACCESS_FINE_LOCATION): Required by the Android operating system solely to discover and sync with external Bluetooth Low Energy (BLE) heart rate monitors. Fyx uses this telemetry strictly for real-time local sonification and autonomic recovery tracking. No location data or biological telemetry is tracked, stored, or mapped outside your immediate active session.
• Camera (CAMERA): Utilized exclusively for the “Thermal Anchor” somatic routine. Fyx only accesses the camera’s LED flash component to generate physical heat. Fyx does not open the camera lens, capture images, record video, or process visual data of any kind.
• Sensors (ACCELEROMETER): Accessed locally to calculate physical pacing and agitation during the “Cortisol Burn” protocol. This movement data is processed in real-time and immediately discarded.

3. LOCAL DATA ENCRYPTION & STORAGE

Any data you voluntarily input into Fyx (such as syllogistic fear maps or session logs) is stored locally on your physical device within an isolated SQLite database.

• Hardware Keystore: Highly sensitive fear inputs are encrypted using an AES-256 cryptographic key generated natively within your device’s Android Hardware Keystore.
• Atomic Sanitization: You maintain absolute control over your data. Fyx provides an “Atomic Purge” feature that permanently executes a hard SQL deletion of your entire conditioning log, rendering it mathematically unrecoverable.

4. MEDICAL DISCLAIMER & LIMITATION OF LIABILITY

READ CAREFULLY: FYX IS NOT A MEDICAL DEVICE. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR PSYCHIATRIC CARE.

Fyx is a self-guided cognitive-behavioral tool designed for exposure conditioning and resilience training. By installing and utilizing Fyx, you expressly acknowledge and agree to the following:

• The developer of Fyx is an independent software architect, not a licensed psychiatrist, psychologist, or medical professional.
• The application induces intentional psychological stress via exposure protocols. You assume 100% of the risk associated with utilizing these protocols.
• If you are experiencing severe psychological distress, suicidal ideation, or clinical psychiatric emergencies, you must immediately close this application and contact emergency medical services.
• Absolute Release of Liability: To the maximum extent permitted by applicable law, in no event shall the developer, creators, or affiliates of Fyx be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to psychological trauma, emotional distress, physical injury, or hardware damage arising out of or in connection with your use or inability to use the application.

5. DISCLAIMER OF WARRANTIES

Fyx is provided strictly on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The developer does not warrant that the application will function uninterrupted, be error-free, or effectively treat any specific psychological condition.

6. GOVERNING LAW & JURISDICTION

This Agreement and your use of Fyx shall be governed by and construed in accordance with the laws of India. Any legal action, dispute, or proceeding arising out of or relating to this Agreement shall be brought exclusively in the competent courts located in Chennai, Tamil Nadu, and you hereby consent to the exclusive jurisdiction of such courts.

7. CHANGES TO THIS POLICY

Because Fyx is an offline application, we cannot notify you of policy changes via in-app push notifications. Any updates to this policy will be reflected in the app store listing or repository where Fyx is hosted. Continued use of the application after an update constitutes acceptance of the new terms.

8. CONSENT

By downloading, installing, or executing the Fyx application, you signify your absolute and unconditional acceptance of this Privacy Policy and End User License Agreement. If you do not agree with any provision of this document, you must immediately uninstall and destroy all copies of the application.

TERMS OF SERVICE AND END USER LICENSE AGREEMENT (EULA)

1. NATURE OF THE SOFTWARE AND ACCEPTANCE OF TERMS

Fyx (the “Application”) is a self-guided, highly intensive cognitive-behavioral exposure software engine. It is provided to you (“User,” “You”) by the independent developer (“Developer,” “We,” “Us”). By executing the Application on your device, you agree to be bound by these Terms of Service. If you do not agree, you must immediately uninstall and destroy all instances of the Application.

2. ABSOLUTE DISCLAIMER OF MEDICAL AND PSYCHIATRIC LIABILITY

FYX IS EXCLUSIVELY A SOFTWARE UTILITY. IT IS NOT A MEDICAL DEVICE, A DIAGNOSTIC TOOL, OR A SUBSTITUTE FOR CLINICAL CARE.

• No Medical Advice: The Developer is a software architect, not a licensed medical professional, psychiatrist, or psychologist. Nothing contained within Fyx should be construed as medical advice, psychiatric diagnosis, or therapeutic treatment.
• Intentional Stress Induction: You expressly acknowledge that Fyx utilizes Exposure and Response Prevention (ERP) architectures designed to intentionally trigger, elevate, and sustain high levels of psychological distress, anxiety, and panic in order to facilitate habituation.
• Emergency Protocols: If you experience extreme psychiatric distress, suicidal ideation, depersonalization, derealization, or a physiological emergency while utilizing this Application, you must immediately terminate the software and contact emergency medical services.
• Assumption of Psychological Risk: You assume 100% of the risk associated with utilizing cognitive exposure protocols. The Developer bears zero liability for emotional trauma, psychological deterioration, panic attacks, or any resulting behavioral consequences.

3. PHYSICAL EXERTION AND HARDWARE DAMAGE DISCLAIMER

Fyx utilizes specific somatic routines that require physical interaction with your device and your physical environment.

• Somatic & Cardiovascular Risk (Cortisol Burn): Certain features (e.g., the “Cortisol Burn” protocol) require the User to execute physical exercises (such as squats or pushups) while the device monitors accelerometer telemetry. You assert that you are in adequate physical condition to perform cardiovascular and strength-based movements. The Developer is entirely shielded from liability for any physical injury, cardiac event, muscular strain, or physical damage sustained while attempting these protocols.
• Hardware Overload Risk (Thermal Anchor): The “Thermal Anchor” routine intentionally drives your device’s Camera LED flash to maximum brightness to generate localized heat for somatic grounding. You acknowledge that prolonged use of the LED at maximum capacity may cause the hardware to overheat, potentially shortening the lifespan of the LED component or the device battery. The Developer assumes zero liability for device degradation, thermal damage, or hardware failure.
• Device Handling: You are solely responsible for the physical security of your device while performing active physical movements with the device in hand. The Developer is not liable for dropped, shattered, or physically compromised hardware.

4. STRICT DATA SOVEREIGNTY AND LOSS OF DATA

Fyx operates on a strictly stateless, zero-footprint architecture.

• No Cloud Backup: Your encrypted Session Ledgers, Syllogistic Fear Maps, and Growth Maps exist entirely in a local SQLite database and Android Hardware Keystore on your specific physical device.
• User-Initiated Destruction: Features such as the “Ephemeral Purge” and “Atomic Sanitizer” are designed to cryptographically and permanently wipe data. Once executed, this data is mathematically irrecoverable.
• Release of Data Liability: Because the Developer has zero access to your device, servers, or encrypted inputs, the Developer cannot restore lost data, recover forgotten Keystore configurations, or undo an Atomic Purge. You bear absolute responsibility for your data retention and destruction.

5. PROHIBITED USES AND LICENSE RESTRICTIONS

Fyx is licensed, not sold, to you for personal, non-commercial use. You agree NOT to:

• Decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Application.
• Utilize the Application’s telemetry algorithms or Ring-0 pinning mechanics to build a competing commercial product.
• Bypass, modify, or tamper with the Android Hardware Keystore implementation utilized by the Application.
• Utilize the Application while operating a motor vehicle, heavy machinery, or in any environment where distracted visuospatial processing could result in injury or death.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, HARDWARE INTEGRITY, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS APPLICATION.

UNDER NO CIRCUMSTANCES WILL THE DEVELOPER BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE APPLICATION OR YOUR HARDWARE KEYSTORE. IN NO EVENT SHALL THE TOTAL LIABILITY OF THE DEVELOPER EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICATION (WHICH MAY BE ZERO).

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Developer from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to Fyx; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party right, including without limitation any privacy or property right; or (iv) any claim that your use of the Application caused physical or psychological harm to yourself or a third party.

8. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION

• Governing Law: This Agreement and your relationship with the Developer shall be governed entirely by the laws of India, without regard to its conflict of law principles.
• Exclusive Jurisdiction: Any legal action, dispute, or proceeding arising out of or relating to this Agreement or your use of the Application shall be brought exclusively in the competent state or federal courts located in Chennai, Tamil Nadu, India. You hereby expressly consent to the personal and exclusive jurisdiction of these courts and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
• Class Action Waiver: You agree that any legal proceedings shall be conducted solely on an individual basis and not as a class action, representative action, or consolidated proceeding.

9. MODIFICATIONS TO THE AGREEMENT

Because Fyx is an offline application devoid of central server communication, we reserve the right to modify these terms at any time by updating the documentation provided in the application marketplace or hosting repository. Your continued use of the Application following any such update constitutes your binding acceptance of the revised terms.

10. ENTIRE AGREEMENT AND SEVERABILITY

This ToS/EULA, coupled with the Fyx Privacy Policy, constitutes the entire agreement between you and the Developer. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
